These general terms and conditions (the \"Terms\") govern access to and use of the mobile application\u00a0<strong>Lean<\/strong>\u00a0(the \"Application\").<br>The Application is published and made available by <strong>Franck Roger BARRIERE<\/strong>, entrepreneur individuel exer\u00e7ant sous le nom commercial Olleris, SIREN 979 320 975, \u00e9tablissement situ\u00e9 au 50 rue de Villacoublay, 78140 V\u00e9lizy-Villacoublay, France (le \u00ab Conc\u00e9dant \u00bb).<br>For any question, you can contact us at:\u00a0<a>support@lean-app.com<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.2. You must read these Terms carefully before using the Application.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2. Acceptance of the Terms<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">2.1. By using the Application, you agree to be bound by these Terms and any updates to them. If you do not accept these Terms, you must uninstall the Application and stop all use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2. The Licensor reserves the right to modify the Terms at any time. Your continued use of the Application constitutes acceptance of the Terms then in force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.3. You must be at least 18 years old, or have reached the legal age of majority in your jurisdiction, to use the Application and subscribe to a subscription.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3. Grant of rights and use of the Application<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">3.1. Subject to compliance with these Terms, the Licensor grants you a personal, revocable, non-transferable, non-sublicensable, limited and non-exclusive right to access and use the Application. All other rights are reserved to the Licensor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.2. You may use the Application only as long as you comply with these Terms.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4. Registration<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">4.1. If you sign in through Apple, Google or any other third-party service, you authorize the Licensor to access the information available there.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.2. Credentials (username, password, etc.) are strictly personal; you must keep them confidential and are responsible for any use made with them. In case of compromise, reset your password immediately. The Licensor may require you to change your credentials at any time.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. Subscriptions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">5.1. The Application operates on the basis of a periodically renewable subscription, unless cancelled through the subscription management feature of your device.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.2. Subscriptions are managed and billed by the application provider (Apple, Google, etc.). Any question regarding billing or refunds must be addressed to them.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6. Updates and support<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">6.1. Access to updates, improvements or new versions is at the sole discretion of the Licensor, who is under no obligation to provide them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2. The Licensor may, without being obliged to, provide assistance through tutorials or online content.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7. Obligations and prohibitions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">7.1. You must use the Application in accordance with applicable laws and regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.2. You must download the Application only from official platforms and use it only on legitimate devices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.3. You are prohibited from sublicensing the Application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.4. In particular, you are prohibited from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>using the Application for unauthorized commercial purposes;<\/li>\n\n\n\n<li>disassembling, decompiling, reverse engineering or creating derivative works;<\/li>\n\n\n\n<li>copying, selling, publishing, distributing or making the Application available to third parties;<\/li>\n\n\n\n<li>removing or altering any proprietary notice;<\/li>\n\n\n\n<li>circumventing security measures;<\/li>\n\n\n\n<li>interfering with the proper functioning of the Application (viruses, overload, etc.);<\/li>\n\n\n\n<li>using the content of the database (Japanese version) for purposes contrary to public order, unlawful or unauthorized commercial purposes.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">8. User content<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">8.1. The Application may allow you to publish content (images, text, etc.) (\"User Content\").<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8.2. You warrant that this User Content:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>is original and does not infringe any third-party rights;<\/li>\n\n\n\n<li>is accurate and lawful;<\/li>\n\n\n\n<li>contains nothing unlawful, defamatory, obscene, hateful or otherwise objectionable.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">8.3. You grant the Licensor, free of charge, a worldwide, perpetual, transferable and sublicensable license to use, reproduce, modify and distribute this User Content for the purposes of operating, promoting and improving the Application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8.4. The same rights apply to the product images you upload (\"Product Images\"). You waive any claim to moral rights over these images.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">9. Intellectual property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">9.1. The Licensor holds all intellectual property rights relating to the Application (code, trademarks, designs, etc.).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.2. You undertake in particular not to register or use similar trademarks and not to infringe the rights of the Licensor.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">10. Term and termination<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">10.1. These Terms take effect upon your first use of the Application and remain valid until terminated by either party.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.2. In the event of a breach of the Terms, the Licensor may immediately terminate your access without notice or compensation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.3. If you uninstall the Application, you lose access to its features and no refund will be owed to you.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">11. No warranties<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">THE APPLICATION IS PROVIDED \"AS IS\" AND \"AS AVAILABLE\". TO THE EXTENT PERMITTED BY LAW, THE LICENSOR DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">12. Limitation of liability and indemnification<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">12.1. TO THE EXTENT PERMITTED BY LAW, THE LICENSOR IS NOT LIABLE FOR ANY LOSS OR DAMAGE, DIRECT OR INDIRECT, RELATED TO THE USE OR INABILITY TO USE THE APPLICATION.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.2. You indemnify the Licensor against any claim resulting from your use of the Application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.3. The Licensor is not liable for erroneous results obtained following the entry of incorrect data.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">13. Distribution platforms<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The terms imposed by your application provider (Apple App Store, Google Play, etc.) apply in addition to these Terms. That provider is a third-party beneficiary and may enforce these Terms against you.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">14. Governing law and jurisdiction<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Governing law and jurisdiction<br>14.1. These Terms are governed by French law, excluding its conflict-of-law rules and the Vienna Convention on Contracts for the International Sale of Goods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">14.2. Any dispute relating to the interpretation, performance or validity of these Terms shall be submitted to the exclusive jurisdiction of the French courts within the jurisdiction of the Paris Court of Appeal.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">15. Miscellaneous<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">15.1. These Terms constitute the entire agreement between you and the Licensor regarding the Application; they supplement, without modifying them, the terms imposed by the download platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">15.2. Any amendment must be made in writing and signed by the Licensor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">15.3. The failure of the Licensor to exercise a right does not constitute a waiver.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">15.4. You may not assign your rights and obligations without the written consent of the Licensor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">15.5.
